If you are facing having your utilities shut off by AEP, Domion, Canton Utilities, Arkon Utilities, City of Massillon, North Canton Utilities, Village of Navarre, New Philadelphia, Canal Fulton or another utility company, then there are several methods which may be utilized to keep your electric or gas from being shut off. These methods include scheduling a payment plan with the utility, state of Ohio assistance programs, providing Medical Certification showing that disconnection would be especially dangerous, or filing for chapter 7 or chapter 13 bankruptcy.
If you owe past due balances on your Ohio utility bills, filing chapter 7 or chapter 13 bankruptcy will prevent your utilities from being shut off. Whether you are filing for Chapter Seven Bankruptcy or Chapter Thirteen Bankruptcy in Ohio, the utility companies cannot refuse, alter or discontinue your service because of your overdue payments.
In the case where your utilities have already been turned off, filing for Chapter 7 Bankruptcy or Chapter 13 Bankruptcy can get your utilities turned back on. Upon filing, your bankruptcy attorney will provide the necessary documentation to the utilities to get your utility services restored. This documentation will also notify them to adjust your bill to reflect that you are filing for bankruptcy.
Past due Ohio utility bills are considered unsecured debts, similar to credit card debt and unpaid medical bills, and therefore are discharged in Chapter 7 Bankruptcy or included in the repayment plan under Chapter 13 Bankruptcies.
Under U.S. Bankruptcy Code, utility companies are prohibited by law from refusing to provide service just because you filed bankruptcy. The utility may require a reasonable deposit to begin new service, however this type of deposit is common for anyone that has fallen behind on their utility bill payments regardless of their bankruptcy filing status.
