State of Ohio Tax Debt and Ohio Chapter 7 Bankruptcy

If you qualify under the bankruptcy means test to file for Chapter 7 bankruptcy protection, your debts that are included in the bankruptcy are discharged, thus creating a “fresh start”. IRS, Ohio, and Local tax debts may be discharged through the bankruptcy if the tax debts meet certain qualifications. If you do not qualify to file Chapter 7 Bankruptcy or your tax debts do not meet the requirements for discharge in the chapter 7 bankruptcy, as an experienced tax attorney, Kenneth Sheppard, Jr. can seek alternatives including negotiating an offer in compromise or payment plan, or removal of the tax debt.

    The tax return filing date is at least 2 years before filing for bankruptcy

    The tax assessment was at least 240 days before filing for bankruptcy

    The filing due date is at least 3 years prior to filing for bankruptcy

    Fraud was not committed in filing of the tax return

    Tax evasion did not occur

 

State of Ohio Tax Debt and Ohio Chapter 13 Bankruptcy

If filing for Chapter 13 bankruptcy is more advantageous to your situation or if you don’t qualify to file for Chapter 7 Bankruptcy, then you may choose to file for chapter 13 bankruptcy at our Canton, Ohio bankruptcy filing office.
