In every Chapter 7 or Chapter 13 bankruptcy filing, we require a $400.00 retainer to start the attorney-client relationship. The retainer may be paid in cash, by personal or business check, or by debit card. A person other than the debtor/client can also use a credit or debit card to make a payment or payments on behalf of the debtor/client. Please note that a debtor/client can only use a debit card, not a credit card, in order to make payments. Ohio Bankruptcy Lawyers are not permitted to accept payment in any bankruptcy case using the bankruptcy filers' credit card.
At time of paying the initial bankruptcy attorney retainer, you may begin referring creditor telephone calls to our office. We will enter into a written fixed fee agreement; we will review and sign some disclosures, and you will be provided a two-page “To-Do List" of the items that we will need to gather from you. Please note that by just paying the initial retainer of $400.00 does not mean that your bankruptcy case is filed.
Note: The initial retainer is included as part of your payment of the overall attorney fees..
If a debtor/client seeks to make payment by debit card only, or, if a person paying on behalf of the debtor/client seeks to make payment by either debit or credit card, you can utilize our online payment portal. At our online payment center, one-time payments can be made or recurring payments may be set up from a variety of recurring payment options. A receipt will be emailed to the email address provided at the time payment is submitted.
We allow you to decide the terms of your payment plan. The bankruptcy attorneys at Sheppard Law understand that our clients have enough to deal with in dealing with their financial difficulties, therefore you can schedule and make payments of your bankruptcy attorney fees and court costs at your own pace. All we ask for is that your total fees and costs are paid within 1 year of entering into the fixed fee agreement. So, whether it takes you one week, one month, or six months to pay your balance, you are in control of your payment plan. Whether you pay in full or whether you make installment payments, that is your decision. Just know that we do not begin any preparation of your petition until the entire amount of the fees and costs are paid and the information from the “To-Do List" is turned into our office. It is the policy of our office that we intend to provide you with a draft copy of your petition for your review within 1 month after receipt of both the full payment of the fees and costs and the information from the “To-Do List".
You are permitted to use your federal and/or state income tax refunds to pay for your Ohio bankruptcy attorney fees and court costs.
The current court cost for filing a Chapter 7 bankruptcy case is $335.00. And the current court cost for filing a Chapter 13 bankruptcy case is $310.00. As these fees do change, please confirm with our office of the current fees.
In Chapter 13 cases only, much of the attorney fees can be deferred and paid from the Chapter 13 reorganization plan. For cases handled in the Northern District of Ohio Bankruptcy Court, the Chapter 13 Bankruptcy requires that at least $500 is paid up-front toward the attorney fees and the remaining bankruptcy attorney fees can be rolled into the chapter 13 debt repayment plan. In addition, the Ohio bankruptcy filer will have the option to pay the court costs up front or to pay them directly to the bankruptcy court in 4 equal installments AFTER the chapter 13 bankruptcy case is filed.
