Tax Debts are a Common Issue in Ohio Bankruptcy Filings

IRS Tax Debt and Ohio Chapter 7 Bankruptcy

If you qualify under the means test to file chapter 7 bankruptcy protection, your unsecured non-priority debts that are included in the bankruptcy can be discharged or "liquidated", thus creating a “fresh start”. IRS and Local tax debts, which are considered unsecured priority, may be dis-chargeable through the bankruptcy if the tax debts meet certain qualifications. If you do not qualify to file for Chapter 7 Bankruptcy or your tax debts do not meet the specific qualifications in order to be discharged in the bankruptcy, as an experienced federal tax attorney, Kenneth Sheppard, Jr. can review alternatives such as an offer in compromise or payment plan, and negotiate with the IRS or other taxing authority to reduce or remove the tax debt.

 

For Income Tax Debts to qualify for discharge in a Chapter 7 Bankruptcy, certain requirements must be met:

 

    The tax return filing date is at least 2 years before filing for bankruptcy

    The tax assessment was at least 240 days before filing for bankruptcy

    The filing due date is at least 3 years prior to filing for bankruptcy

    Fraud was not committed in filing of the tax return

    Tax evasion did not occur

 

IRS Tax Debt and Ohio Chapter 13 Bankruptcy

You may choose to file for Chapter 13 Bankruptcy if filing for Chapter 13 is more advantageous to your situation or if you don’t qualify to file for Chapter 7 Bankruptcy.  One advantage of filing Chapter 13 Bankruptcy is that tax debts determined to be priority may be paid back through the life of the Chapter 13 repayment plan. Priority tax debts typically include tax liens, withholding taxes (FICA, Medicare, & Income taxes owed for employees pay, sales taxes), some employment taxes, certain tax penalties, and erroneous tax refunds.

 

Income Tax debts treated as priority debts for chapter 13 must stand up to the same test as for Chapter 7 bankruptcy:

 

    The tax return filing date is at least 2 years before filing for bankruptcy

    The tax assessment was at least 240 days before filing for bankruptcy

    The filing due date is at least 3 years prior to filing for bankruptcy

    Fraud was not committed in filing of the tax return

    Tax evasion did not occur
